The purpose of this communication is to inform all interested stakeholders of the opportunity to submit public comments on the proposed implementation of Performance-Based Contracting for Supports Coordination services and proposed additional changes to the Consolidated, Community Living, and Person/Family Directed Support (P/FDS) Waivers that are not related to Performance-Based Contracting effective January 1, 2026. The public comment period starts on April 19, 2025, and ends on May 26, 2025, at 11:59 PM for all proposed changes in this communication.

The Office of Developmental Programs (ODP) requests your assistance sharing the attached communication, ODPANN 25-040 Clarification on Monitoring of Chapter 2380 and 2390 Regulations for Individuals Who Reside in ICF/ID Settings. The purpose of this communication is to clarify which regulatory requirements in Chapters 2380 and 2390 will and will not be monitored during licensing inspections when applied to individuals who reside in Intermediate Care Facilities for Individuals with Intellectual Disabilities (ICF/ID) settings and attend facility-based day services. The Council released a statement about the federal government's proposal to dismantle the Administration of Community Living (ACL). This change, along with several other recent decisions, will impact services for people with developmental disabilities.
